Specific conditions: “à la carte” services

These specific conditions apply to the beneficiaries of our “à la carte” services in addition to our Terms of Service. By subscribing to any of these services, you agree to comply with our Terms of Service and these special conditions.
Subscriptions and pricing
Any member of the association, whether an individual or a legal entity, may subscribe to one or more services from a catalog of “à la carte” services provided by the association, depending on availability. Subscriptions are subject to a fee and some discounts may apply.
Unless expressly requested, invoices are paid annually by bank transfer to facilitate the accounting operations carried out by our limited staff.
La Contre-Voie may change the prices of its services at any time without notice. However, a service already charged to a beneficiary will not be subject to a rate increase until the next billing date. La Contre-Voie will endeavor to communicate the new rates to beneficiaries as soon as possible.
La Contre-Voie implements “à la carte” services within a maximum of 7 working days from receipt of payment of the invoice (or beforehand), subject to prior availability of the necessary access (e.g. DNS zone for domain names) and completion of any formalities with the beneficiaries (diagnosis, validation of specifications, agreement on the proposed service as a whole).
When purchasing a domain name through La Contre-Voie, beneficiaries agree to provide accurate and up-to-date identification information in accordance with the French law.
Right of withdrawal
Beneficiaries of “à la carte” services have a 14-day period from the time they have subscribed to the services to exercise their right of withdrawal, resulting in a refund of the amounts involved in the subscriptions.
Certain expenses are not subject to the right of withdrawal. Beneficiaries will have waived their right of withdrawal in advance for those:
- Costs incurred by La Contre-Voie with third parties for the installation of the service (e.g. domain name);
- Any set-up fees explicitly mentioned as such on the invoice;
Once this 14-day period has elapsed, the services offered cannot be exchanged or refunded.
Subscription renewal
Unless expressly specified, “à la carte” services subscriptions are automatically renewed each year, on the expiry date of the previous subscription.
- An invoice is sent to beneficiaries at least 15 days before this due date.
- A reminder will be sent when the invoice is due.
- If the invoice is not paid within 5 days after the due date, La Contre-Voie is entitled to suspend access to the services.
- If no payment is received more than 30 days after the invoice due date, or 25 days after the suspension of the services, La Contre-Voie is entitled to delete the associated data.
Subscription modification
Beneficiaries may request changes to the services they have subscribed to at any time during their subscriptions:
- to add services to the catalog of services offered by the association;
- to modify subscribed services by adding or deleting options, or modifying quotas among the proposed options;
- to remove services from the subscription.
This modification may result in a re-evaluation of the subscription price, which will be invoiced on a pro rata basis until the next subscription expiry date.
Cancellation
Beneficiaries may cancel their subscriptions at any time, resulting in the termination of the services provided and the deletion of associated data. Such cancellation has no effect on their membership of the association.
Cancellation of subscriptions beyond the right of withdrawal period does not constitute a condition for a refund.
La Contre-Voie also retains the right to cancel subscriptions at any time in the event of a violation of these TOS and/or French law.
Warranty and support
La Contre-Voie implements technical means to limit the impact and risk of breakdowns, but offers no contractual guarantee of service operation, which may be temporarily unavailable in the event of malfunction or technical maintenance.
La Contre-Voie undertakes to make its best effort to maintain its services unaltered when encontering technical issues.
Beneficiaries may contact La Contre-Voie for any request regarding technical assistance, and La Contre-Voie undertakes to respond to such requests within a reasonable interval, within the limits of its means and possibilities.
Liability
As stated in the Terms of Service, despite all the measures and protections put in place to prevent data loss and secure the infrastructure, La Contre-Voie cannot be held responsible in the event of loss or theft of hosted personal data, whatever the circumstances.
Beneficiaries are entirely responsible for securing their login details and managing their access rights to subscription services, and undertake to contact La Contre-Voie in the event of unauthorized access to those services. La Contre-Voie may require beneficiaries to improve their security management if it becomes aware of any shortcomings that could threaten its infrastructure.
